Subject: Repeat Report – Unrepaired Pothole and Failure to Meet Legal Maintenance Duties
I am reporting this pothole yet again, as despite multiple previous reports it remains unrepaired and continues to worsen, while I receive nothing but the same automated replies claiming the road is “regularly inspected,” which is clearly and demonstrably inaccurate. The defect now poses a serious and avoidable danger to motorists, cyclists, and pedestrians, who are forced to swerve into oncoming traffic to avoid it. Under the Highways Act 1980 you have a legal duty to maintain the road in a safe condition and to take reasonable action once a defect has been reported; this ongoing inaction suggests those obligations are not being met. As such, I would like a non‑automated response, an explanation for the lack of action, and a specific date by which this pothole will finally be repaired.
If this matter continues to be ignored, I will escalate the issue through the Council’s formal complaints process and, if necessary, to the Local Government Ombudsman, as the current handling represents a failure of service and a breach of statutory duty. I expect a substantive response and prompt action.
