Dear Sir or Madam,

I am writing to report an issue regarding a roadside tree located along the main road adjacent to my property at 9 Woburn Close, Banbury, OX16 9FT. The tree overhangs the rear boundary of my garden, and falling leaves and branches have been causing ongoing problems.

The debris regularly accumulates in my garden, blocks the gutters, and poses potential safety concerns during windy weather when branches occasionally fall.

I would be grateful if the Highways Agency (or the relevant department) could inspect the tree and take appropriate action — whether pruning, maintenance, or removal — to prevent further encroachment and to ensure safety for both residents and road users.

I have attached several photographs for your reference to help illustrate the situation.

  • Thank you for your enquiry, I have visited site and inspected the trees & vegetation as described in the enquiry. The trees & vegetation present appears to be growing beyond the area that OCC maintains and is therefore deemed to be an adjacent boundary feature. OCC, as the local highway authority, maintain the HMPE (highway maintainable at public expense) from boundary feature to boundary feature, but not the actual boundary features themselves. As such the vegetation present is maintainable by the adjacent property/landowner, and not the County Council. Adjacent landowners may maintain their trees & vegetation as they wish within the guidelines of relevant legislation.
