I received a response to my report of overgrown trees causing problems for residents of Broadfields. I was informed that the trees are not on council property and provided a link to the land registry website. The trees in question are on the strip of land marked on the attached map, which borders the carpark. They are not growing on the train tracks side of the fence. The land is not listed on the land registry and I don't know how else to identify the owner if its not the council, which it seems to us that it would be?

  • Good morning Ms Pullen, thank you for your enquiry. The trees shown in the images are not growing on part of the highway maintainable at public expense and not the responsibility of Oxfordshire County Council. I note that you have consulted Land Registry mapping. The unregistered land may be under the management of Network Rail. If you can demonstrate that the trees are part of a boundary installed by the predecessors of Network Rail or by Network Rail the trees will be the responsibility of Network Rail. However, if the trees are beyond the boundary of the railway they are not the responsibility of Network Rail but of the adjacent land owners. You will need to consult Land Registry to find the owners of the parking spaces adjacent to the railway. If this is the case, the tree owners can manage the trees as they wish but should have regard to their duty of care. I recommend that you contact Network Rail to start the process of determining ownership of the trees. If I can be of further help please contact me at matthew.hirons@oxfordshire.gov.uk.
