Inappropriate give way marks on cycle path

At this location, traffic exiting St Edwards crosses the pavement before entering the road. The cycle lane has give way lines here. In reality the traffic exiting St Edwards should be giving way to the pavement, as per highway code rule 206.

I was recently driven into here by a driver exiting St Edwards, while I was on the cycle path. St Edwards bursar told me in writing that I should have given way, and backed himself up by pointing out the (inappropriate) cycle lane markings.

The cycle lane give way markings should be removed, and the give way line at the exit from St Edwards should be repainted.

  • Thank you for bringing this to our attention and the situation will be reviewed in light of this incident.

    However due to the lack of advance visibility for all road users on the access road to view those on the cycle track that neither the cycle track users or access road users are granted priority over the other.

    Highway Code 206 is for all road users requiring to proceed with extra care and to drive/ride carefully and slowly, to safely give way when appropriate.

    Those leaving the private access should give way to pedestrians on the pavement and cyclists using a cycle lane on a cycle track. This is not possible at this location due the visibility restrictions for those exiting the access road.

    At this location the vehicle is having to encroach into the cycle lane before the driver is able to observe any cycle track users, increasing the risk of conflict between the cyclist and vehicle. In such a scenario the cyclist is encouraged to give way to the vehicle leaving the access hence the road markings on the cycle track.
