Fir tree very low overhanging path I am 5 ft 3in and too low for me to walk under.

  • Thank you for your enquiry. The tree described in the enquiry is on 3rd party land. OCC is responsible for maintaining tree(s) on land deemed to be within the highway maintainable at public expense (HMPE). OCC may observe trees on 3rd party land adjacent to the highway which are an imminent danger to the highway, e.g. large dead trees, trees with extensive obvious decay or damage etc. and require immediate intervention, using statutory powers within the Highway Act 1980. At the time of my assessment, the tree does not present an imminent danger to the HMPE, if you would like to progress the issue you must contact the 3rd party landowner.
