Thank you for your enquiry. I have visited the location and assessed the tree. The tree present are the responsibility of the adjacent landowner and not by the County Council. You need to contact the landowner to request any works. If you do not know the landowner, I advise that you access the Land Registry, to find details of the adjacent landowner to progress your enquiry with them. I can advise you that the registered land owner was a development company that has been dissolved. You are within your common law rights to cut any overhanging vegetation back to the boundary line of your property, providing the work is not detrimental to the tree. I will advise my highways colleagues that an encroachment issue exists at this location.
