Neighbour trying to take over land

My neighbour has had a metal fence up around a public bit of land for almost 3-4 years now. He has made no effort to put a fence up (a proper fence), has left the garden become over grown and now has dug the whole thing up. Initially when this started he told me someone let him down to replace the fence - this of course has never happened and the excuse was, the man let him down. I do not think the fence was ever going to happen. I have tolerated it enough, so have my neighbours and also the dog walkers who ask me questions about when will it be finished etc. we have all had enough now especially as the pathway with all the rain will become muddy now after digging it up. I have 2 children and have to use this pathway as a way out of my house I do not think that this is safe either

  • A fence will not be put up, he is now putting a hedge in, and by the looks of it, it will be right up against the path way which I’m sure is public land. I worry for the path that all of us need to use to access our front doors, as well as others that use the pathway as the roots may grow underneath and cause more issues.

  • Fence is still up and land seems to have been taken over by new turf and assuming the hedge will be on the outer edges which may damage the path. See attached recent images. This is right at the top of Humber Walk on the footpath. If you drive to the top you cannot miss the fencing.
