Planting on public highway

The owner of 36 Fawkner Way has taken it upon themselves to plant Beech saplings and various bushes on the grass verge to prevent on street parking to the side of his property. You can clearly see the highway boundary markers , when the grass is cut , and the planting is all over that boundary. Also it’s just a mess already . Any help you can offer will be greatly appreciated.

For Information purposes: It is an offence to plant a tree within 15 feet of the centre of a carriageway. Section 141(1) and 141(3) The Highways Act 1980.

Large stones have also been placed on land which forms part of the highway. This causes a trip hazard when entering and leaving vehicles.

I agree the rocks/stones on the kerb are definitely a hazard and are basically on the public highway and way beyond the boundary line !!! How long before someone damaged their car or themselves on them

Anonymous reporting seems kind of passive aggressive - has anyone spoken to the house owner? I'm happy to go have a word if not.

Dan, you do not need consent from the original anonymous reporter to "go have a word". I don't see this website as any form of aggression though; it is after-all, its purpose to receive reports of inter alia issues with the public highway which includes grass verges set aside for pedestrian traffic including predominantly reports made "anonymously". Please speak to the owner if you want to but I anticipate that if the owner refuses to remove the offending trees and vegetable gardens (which cover-up the boundary marker) and the dangerous rocks then you do not have the authority to compel him. The County Council do.

Mystery commenter: I wasn't seeking consent, I was asking if this hadn't already been tried so I don't waste my time. What a sad world we live in if issues with neighbours are reported to the council before simply talking to them.

Is there anyway someone from the highway/council can provide some sort of update on this issue as the planting is ongoing and now covers a BT inspection junction box cover for the surrounding houses phone/broadband connections

Someone was going to speak the man at 36 about his dumping rocks in the highway and his tree planting etc a couple of weeks ago. Obviously it did no good.

Planting etc still ongoing , now several things are growing which is going to impact on people’s legal right to park on the roadside next to a public verge . Is anyone from the local authorities looking into the legality of this ??

Hello. (For the benefit of the original poster). The Council do not see "updates", only the original report. If this is still going on, you should report it in a fresh report but refer the reference number of this report. The owner of the house appears to think he is the owner of the public highway - clearly he is not and clearly he is not allowed to plant on the highway (the verge is the highway) but he may not know this. Did anyone pay him a visit to explain that his actions are causing concerns? One thing though; the rocks have been present long before this post - google maps street view show the rocks in 2008.

This has gone beyond the original complaints now !! Homeowner has even erected some sort of metal archway on the public highway over a lamppost, verge is now so overgrown it’s just scruffy and illegal
