Tree on public walkway limiting access to property, roots are destroying and lifting the tarmac presenting a surface hazard to access back of the property number 2 and 3 Lee Close , some branches hanging down on the path to a height of circa 1 meter from ground as well as starting to overarching andlean on neighbours fences (Lee Close and Marlborough Close). Dangerous as already bend an ankle when trying to access back garden gate via the uneven and broken surface. I spoke on site to someone from the council autumn last year and my understanding form this conversation was that the council will take care of this, however nothing happened so far. Hence the registering now the issue.

We have visited site and assessed the trees in their location. OCC maintains land that is HMPE (highway maintainable at public expense) in its capacity as local highway authority. The trees referred to in the enquiry are on land that is not HMPE. You can access the land registry at: https://www.gov.uk/ search-property-information-land-registry to find details of the adjacent landowner to pursue your enquiry. It may also be appropriate to contact the District, Town or Parish Council to further your enquiry. You are also within your common law rights as a landowner to cut any overhanging or encroaching vegetation back to the boundary line of your property.
