Trees overhanging onto my property from public pathways

Sent to Oxfordshire County Council less than a minute later

The trees that line the bure park path that runs Parallel to the Banbury road are overhanging onto our driveways and the trees from the public space next to the pathway that is adjacent to the Banbury road overhang into our garden and are causing a hazard to the children.

  • We have visited site and assessed the trees in their location. OCC maintains land that is HMPE (highway maintainable at public expense) in its capacity as local highway authority. The trees referred to in the enquiry are on land that is not HMPE. You can access the land registry at: https://www.gov.uk/ search-property-information-land-registry to find details of the adjacent landowner to pursue your enquiry. It may also be appropriate to contact the District, Town or Parish Council to further your enquiry. You are also within your common law rights as a landowner to cut any overhanging or encroaching vegetation back to the boundary line of your property.
