Overhanging tree at the bottom of our garden

We have lived at our property for 4 years and have an overhanging tree at the bottom of our garden which is out of our boundary, getting bigger and bigger each year, that drops hundreds of branches and all year round and in the height of spring/summer releases lots of fluffy stuff which causes terrible hayfever in our son and in the autumn absolutely covers our garden in leaves, making our garden a complete mess all the time. I have tried contacting both oxfordshire and cherwell council and no one is accepting ownership of this problem. Please can someone get in touch with me regarding this issue as I would like it taken care of before it all begins to grow back from the autumn- I can provide more photos if need be. Also, i would like to make a complaint of sound during very unsociable hours by a business behind our property, again has been going on for many years now and we are fed up with it. please can i be pointed in the right direction for this as well. Thank you

  • Please provide the exact property number so that an appropriate response to the tree enquiry can be made. I am unsure whether the noise report should be passed to Oxfordshire County Council to investigate. This issue is likely to be dealt with by Cherwell and therefore I would advise going to their website to log the specific noise enquiry.

  • Still open, via questionnaire, 13:34, Saturday 29 February 2020

  • The house number is 16 Fallowfields. I was sent to Cherwell last time I contacted you and they hugged at me and told me it was OCC issue. I tried contacting them a couple more times and I was ignored.

  • The location has been assessed. The overhanging tree is on land not deemed to be part of the publicly maintained highway by Oxfordshire County Council in our capacity as local highway authority. You are advised to contact land registry to determine who is responsible for the land on which the tree is growing and therefore have responsibility of the tree. In this case though I would remind you, that you are entailed to maintain your boundary. Furthermore in relation to the noise complaint this is a matter that must be taken up with Cherwell District Council.
