Metal spikes on the fence at the begging of the cycle path going down towards Headington from the Corner house pub. Member of the public lost control of the bike and spike injured her neck

I have attach a photo of where the fence is - it is covered by the bush shown in the centre of the attached photo/map. As mentioned in the original report, one of the spikes on the fence penetrated my neck, creating a hole the size of a 5p piece all the way through to my trachea as I attempted to enter the cycle path at this location.

I reject your claim that this report is not the responsibility of the council. Under the Highways Act 1980 you have the responsibility to maintain the highway. Under that act, section 164, you also have the power to require the removal of dangerous fences adjoining the highway:
"Where on land adjoining a highway there is a fence made with barbed wire, or having barbed wire in or on it, and the wire is a nuisance to the highway, a competent authority may by notice served on the occupier of the land require him to abate the nuisance..."
This fence is a danger to users of the highway, and is liable to cause serious injury or death in the future, for which the council could be legally liable.
