Dangerous road works by developer

Blenheim Estates are carrying out the highways works to facilitate the development of new houses. There are 2 issues with these works at the moment: 1) For a period of time, although now removed, there has been heras type fencing adjacent to the carriageway. This was not installed in accordance with the manufacturer's details and therefore does not comply with temporary works design for this fence to be adjacent to the public, and could therefore be dangerous if it were to fall over 2) There is a significant unguarded or protected excavation, approx 2-3ft deep, adjacent to the carriageway. This is a 50mph main road, so this is not acceptable and creates a significant risk for the travelling public

Thank you for your report. Our Streetworks Team have contacted the developer and they have (as you mentioned) removed the Harris fencing and have confirmed the tarmac will be reinstated today. We will continue to monitor. Thank you.

Nothing has been done to protect or reinstate the excavation. There is still a 2-3ft deep excavation immediately adjacent to the live carriageway, meaning a dangerous situation has now been allowed to continue for a long period, thereby increasing the risk to the public. I am sure that these works are far from being in accordance with the Code of Practice for Safety at Street Works and Road Works, which are one of the standards that should be worked in accordance with? What risk assessment has been done to ensure these works are safe?

While the developer has undertaken some surfacing works to part of this issue, the deepest and therefore most dangerous excavation has still not been filled or protected. As you seem unable or unwilling to address this issue, I will be contacting the HSE
