A tree which has fallen on land beside the road has upper branches which encroach on the highway.

  • We have visited site and assessed the trees in their location. OCC maintains land that is HMPE (highway maintainable at public expense) in its capacity as local highway authority. The trees referred to in the enquiry are on land that is not HMPE. You can access the land registry at: https://www.gov.uk/ search-property-information-land-registry to find details of the adjacent landowner to pursue your enquiry. It may also be appropriate to contact the District, Town or Parish Council to further your enquiry. You are also within your common law rights as a landowner to cut any overhanging or encroaching vegetation back to the boundary line of your property.
